Terms of Service

To use certain features of the App, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials and login codes
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

Zeitarc uses passwordless authentication via one-time login codes (OTP) sent to your registered email address, or Google Sign-In. You are responsible for maintaining access to your email account and keeping your authentication secure.

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the App, you consent to the practices described in the Privacy Policy.

When you create an account, you explicitly consent to our Terms of Service and Privacy Policy. Your consent is versioned and recorded. When we make material changes to these Terms or the Privacy Policy, you will be asked to review and re-accept them before continuing to use the App.

We use anonymous analytics (PostHog) and error tracking (Sentry) to improve the App. You can opt out of analytics at any time via Settings > Privacy & Data. Error tracking for crash reports remains active to ensure App stability.

You retain all ownership rights to the content you upload to Zeitarc, including photos, text, and other materials ("User Content"). Your memories belong to you.

By uploading User Content, you grant us a limited, non-exclusive, non-transferable license to store, process, and display your content solely for the purpose of providing the App's services to you. We will not use your content for any other purpose without your explicit consent. This license terminates when you delete your content or account.

You are solely responsible for the User Content you upload. You represent and warrant that you have all necessary rights and permissions to upload your content and that your content does not violate any third-party rights.

You agree not to upload content that:

• Violates any applicable law or third-party rights
• Contains malware or harmful code
• Is fraudulent, deceptive, or misleading
• Infringes intellectual property rights
• Contains illegal, abusive, or exploitative material

We reserve the right to remove User Content that violates these Terms or applicable law, without prior notice. We are not obligated to monitor User Content but may do so at our discretion.

Zeitarc offers both free and premium features. Some features may require a paid subscription. The features included in each tier are described in the App.

If you purchase a subscription, payment will be charged to your Apple App Store or Google Play Store account. All billing is handled by the respective app store platform.

Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. You can manage and cancel subscriptions through your app store settings.

Refunds are subject to the policies of Apple App Store or Google Play Store. We do not process payments or refunds directly. Contact the respective app store for refund requests.

If you are a consumer in the European Union, you have the right to withdraw from a digital content purchase within 14 days of the transaction without giving any reason, in accordance with the EU Consumer Rights Directive (2011/83/EU).

However, by starting to use a paid subscription immediately upon purchase, you acknowledge and agree that you lose your right of withdrawal once the digital content has been fully provided. Where the digital service is ongoing, you may still cancel your subscription for future billing periods through your app store settings.

All withdrawal and refund requests are processed through the Apple App Store or Google Play Store, as they handle all billing on our behalf.

You may request deletion of your account at any time through the App (Settings > Privacy & Data > Delete Account) or by emailing privacy@zeitarc.com. When you request deletion:

• Your account enters a 30-day grace period
• During this period, you can restore your account by logging back in and choosing "Restore My Account"
• After 30 days, your account and all associated data (timelines, photos, memories) are permanently and irreversibly deleted
• Active subscriptions should be cancelled separately through your app store to avoid continued billing

During the 30-day grace period following a deletion request, you can restore your account by logging in with your email and choosing "Restore My Account". All your data will be preserved and your account will return to normal operation.

We may suspend or terminate your access to the App if you violate these Terms, engage in fraudulent activity, or for any other reason at our reasonable discretion. We will provide notice where practicable.

Upon termination, your right to use the App ceases immediately. We will delete your data in accordance with our Privacy Policy and the retention periods described therein.

Before filing any formal proceedings, you agree to first contact us at legal@zeitarc.com to attempt to resolve any dispute informally. We will make good faith efforts to resolve disputes within 30 days.

These Terms are governed by and construed in accordance with the laws of Pakistan. Where you are a consumer within the European Union, you also enjoy the protection of the mandatory provisions of the consumer protection laws of your country of residence.

Any disputes that cannot be resolved informally shall be submitted to the courts of competent jurisdiction in Islamabad, Pakistan. If you are a consumer in the EU, you may also bring proceedings in the courts of your country of residence.

The European Commission provides an online dispute resolution (ODR) platform at https://ec.europa.eu/consumers/odr. We are not currently obligated to participate in dispute resolution proceedings before a consumer arbitration board, but we will always endeavour to resolve disputes directly with you.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Zeitarc regarding your use of the App, superseding any prior agreements or communications.

We may assign our rights and obligations under these Terms to another entity in connection with a merger, acquisition, or sale of assets, provided that the assignee agrees to be bound by these Terms. You may not assign your rights or obligations without our prior written consent.

We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, power failures, internet disruptions, or acts of third parties.

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by us.
